Terms of use

Article 1 — Subject

These Terms of Service (hereinafter the "ToS") govern the use of the Tresorus mobile application and website (hereinafter the "Service"). Tresorus is an immersive treasure hunt application that allows Users to discover local heritage through geolocated trails, educational videos and puzzles.

By creating an account or using the Service, the User unreservedly accepts these ToS.

Article 3 — Access to the Service

Access to the Service is free of charge. Registration requires a valid email address, a username and a postal code. The User undertakes to provide accurate information and to maintain the confidentiality of their credentials.

A guest mode allows the User to explore certain features without creating an account. This mode does not allow progress to be saved nor badges to be collected.

The Service requires a compatible mobile device (iOS or Android), an internet connection and the activation of location services for gameplay.

Article 4 — Minimum age and family use

The Service is intended for persons 15 years and older. In accordance with Article 45 of French Act No. 78-17 of 6 January 1978 (French Data Protection Act), account creation is reserved for persons aged 15 or older, or for legal guardians acting on behalf of a minor.

Minors under the age of 15 may use the Service under the direct supervision of a parent or legal guardian who has themselves created the account. Outdoor trails must always be carried out under the responsibility of an accompanying adult.

Article 5 — Personal data

The processing of personal data is described in our Privacy Policy. HEXAI undertakes to comply with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

The User may, at any time, exercise their rights of access, rectification, erasure and portability by contacting contact@tresorus.fr.

Article 6 — Geolocation and safety

The Service uses real-time GPS geolocation during gameplay to guide the User to points of interest. This feature requires the User's authorization and may be disabled in the phone settings. Location data is processed in real time and is not stored on our servers.

Outdoor safety:

• The User is solely responsible for their physical safety during outdoor trails
• It is recommended to remain attentive to one's surroundings, in particular to traffic and terrain
• Trails must never be undertaken while driving a vehicle
• Children must be accompanied by an adult

Article 7 — Intellectual property

All content of the Service (texts, videos, images, trails, characters, puzzles, logos, trademarks) is the exclusive property of HEXAI or its partners and is protected by intellectual property law.

The User benefits from a personal, non-exclusive and non-transferable license to use the Service for their personal use. Any reproduction, modification or distribution of the content without prior written authorization is prohibited.

Article 8 — Liability

HEXAI endeavors to ensure the availability and proper operation of the Service. However, the Service is provided "as is" and HEXAI does not guarantee uninterrupted availability.

HEXAI shall not be held liable for any direct or indirect damages resulting from the use of the Service, in particular:

• Damages related to outdoor use (falls, accidents)
• Inaccuracy of GPS data or unavailability of the signal
• Loss of data in the event of a technical failure

Article 9 — Termination and account deletion

The User may delete their account at any time directly from the application or by contacting contact@tresorus.fr. Deletion results in the permanent erasure of all associated data (profile, progress, badges).

HEXAI reserves the right to suspend or delete an account in the event of a breach of these ToS, without notice or compensation.

Article 10 — Modification of the ToS

HEXAI reserves the right to modify these ToS at any time. The User will be informed of any changes by email or by notification within the application. Continued use of the Service after notification shall constitute acceptance of the new terms.

Article 11 — Applicable law

These ToS are governed by French law. In the event of a dispute, the parties shall endeavor to find an amicable solution. Failing that, the competent courts shall be those of the jurisdiction of HEXAI's registered office.
